Terms and Conditions

By accessing, browsing, or booking any travel service through Triptrails the user irrevocably agrees to be bound by these Terms & Conditions.

If you do not agree, you must not proceed with any booking.

1. Nature of Triptrails’ Services

Triptrails is only a facilitator and booking agent.

We:

  • Do not operate, own, manage, control, or endorse any airline, hotel, transport provider, tour operator, or other travel service.
  • Act solely as an intermediary between the User and the respective service provider.

All travel services are:

  • Provided entirely by third-party service providers
  • Subject to their rules, regulations, conditions, and operational decisions

Triptrails shall not be deemed a principal, carrier, hotelier, tour operator, or service provider under any circumstance.

2. Binding Nature of Supplier Rules

By booking through Triptrails, the User expressly agrees to be bound by:

  • Airline Conditions of Carriage
  • Hotel rules and policies
  • Tour operator terms
  • Transport provider regulations
  • Airport, immigration, and government authority rules

In case of conflict, supplier rules shall prevail over any information displayed on Triptrails.

3. No Warranty / No Guarantee

Triptrails provides all information “as is” and “as available”.

Triptrails does not guarantee:

  • Accuracy of schedules
  • Seat availability or seat assignment
  • On-time departure or arrival
  • Hotel room category, view, amenities, or quality
  • Continuity of services
  • Pricing stability

Any representations are indicative only and not binding.

4. User Responsibility for Travel Details

The User is solely responsible for:

  • Correct passenger names (as per passport/ID)
  • Travel dates, sectors, and preferences
  • Passport validity, visas, transit visas
  • Health requirements, vaccinations, insurance
  • Compliance with immigration, customs, and local laws

Triptrails shall not be liable for:

  • Denied boarding
  • Deportation
  • Entry refusal
  • Missed connections
  • Visa rejections

5. Pricing, Fares & Errors (IRCTC-Aligned)

  • All prices are dynamic and subject to change without notice.
  • Triptrails reserves the right to cancel bookings arising from pricing or technical errors, even after payment.
  • Taxes, fees, surcharges, convenience fees, and service charges may change at any time.
  • Triptrails’ service fees are non-refundable under all circumstances.

6. Payments

  • Full payment must be received before booking confirmation.
  • Triptrails is not responsible for payment gateway failures, bank delays, or technical issues.
  • Failed or pending payments do not guarantee booking confirmation.

7. Cancellations, Amendments & Refunds

  • All cancellations, changes, and refunds are governed exclusively by the service provider’s policy.
  • Triptrails has no authority to override airline/hotel/tour operator decisions.
  • Refund timelines depend entirely on third parties.
  • Triptrails shall not be liable for:
    • Partial refunds
    • Non-refunds
    • Delayed refunds

Triptrails’ convenience fees, service charges, and administrative fees are strictly non-refundable, even if the booking is cancelled, unused, or partially used.

8. Schedule Changes, Delays & Disruptions

Triptrails is not responsible for:

  • Flight delays, cancellations, diversions
  • Schedule changes
  • Hotel overbooking
  • Denial of services by suppliers

Any assistance provided by Triptrails is purely voluntary and shall not create any obligation or liability.

9. Force Majeure (Broad Protection)

Triptrails shall not be liable for failure or delay caused by:

  • Natural disasters
  • Epidemics or pandemics
  • Government orders or travel restrictions
  • War, riots, strikes, technical failures
  • Acts beyond reasonable control

No refunds, compensation, or damages shall be claimable from Triptrails in such cases.

10. Limitation of Liability (IRCTC-Style Cap)

To the maximum extent permitted by law:

  • Triptrails shall not be liable for indirect, incidental, consequential, punitive, or special damages.
  • Triptrails’ total liability, if any, shall be strictly limited to the service fee charged by Triptrails for that booking.
  • Triptrails is not liable for mental agony, loss of enjoyment, or inconvenience.

11. Indemnity

The User agrees to fully indemnify and hold harmless Triptrails, its directors, employees, and affiliates against all claims, losses, damages, penalties, or expenses arising from:

  • User’s breach of these Terms
  • Incorrect or false information provided
  • Violation of laws or supplier rules
  • Acts or omissions of third-party service providers

12. Right to Refuse or Cancel Bookings

Triptrails reserves the absolute right, without notice, to:

  • Cancel or refuse any booking
  • Suspend or terminate user access

Including but not limited to cases of suspected fraud, misuse, or legal non-compliance.

13. Intellectual Property

All website content, trademarks, logos, and software belong exclusively to Triptrails or its licensors. Unauthorized use is prohibited.

14. Privacy & Data Protection

Use of Triptrails is subject to our Privacy Policy and Cookie Policy, which form an integral part of these Terms.

15. Governing Law & Exclusive Jurisdiction

These Terms shall be governed by the laws of India.

All disputes shall be subject to the exclusive jurisdiction of courts at [City, India], irrespective of the user’s location.

16. No Waiver & Severability

Failure to enforce any provision shall not constitute a waiver.
Invalid provisions shall not affect the validity of remaining clauses.

17. Amendments

Triptrails may modify these Terms at any time without prior notice. Continued use constitutes acceptance.
